Case: Eros v. Simon (SETTLED 2007) - Second Life

Somehow this well reported case got overlooked here at the Patent Arcade, and that appears to be because I thought I’d already written about it. In any event, it now gets its own post…

On October 24, 2007, six content owners in Second Life sued Thomas Simon, aka Rase Kenzo, for infringing their copyrights in various online goods. Also included in the complaint were counts for unfair competition and false description of origin, conspiracy, and counterfeiting. The goods included clothing and scripted furniture (aka, sex beds), among other things. After only two months it appears that Mr. Simon saw the light and the plaintiffs proved their point–the case settled in December, 2007, for about $525, and an agreement by Mr. Simon to cease his questionable activities.

At the very least this case is important because it demonstrates the seriousness that many Second Life content creators give to their businesses, treating their intellectual property just as any other business would. The stakes will only get higher as virtual worlds such as Second Life get bigger, and the players have even more money at stake.

Case: Tafas v. Dudas (USPTO rules)

Today the U.S. District Court for the Eastern District of Virginia granted Tafas’ and Smithkline Beecham’s Motions for Summary Judgment, effectively holding that the USPTO’s proposed 5/25 and 2+1 rules regarding claims and continuation practice are illegal, and therefore null and void.

The case is: Tafas v. Dudas, Docket No. 1:07cv846, as combined with Smithkline Beecham Corporation v. Dudas, Docket No. 1:07cv1008, in the Eastern District of Virginia, before judge Cacheris.

Battle of the ‘Bams!’: Resistance 2 vs. Killzone 2

Sony has two major FPS offerings on tap for releases in the next nine-odd months, both of which have plenty of similarities - not the least of which are their sci-fi trimmings. But how do they differ from one another … or stack up against other big titles in the genre? Enter MTV’s Multiplayer, who have put together a nice comparative feature on the two games, covering points such as visuals, gameplay, and overall themes. Oh, and the abundance of earth tones, of course.

Is there room on PS3 for two similar first-party titles? We say “yes,” and “please make sure they’re better than Haze.” Read on for Multiplayer’s observations, along with some developer insight on Sony’s positioning of both first-person battles against creepy creatures and … Space Nazis.

No Extra Character Slots For WoTLK

For all you altaholics out there who maxed out your character slots for your server, WoW-EU CM Vaneras brings bad news concerning Wrath of the Lich King and character slots.

We don’t plan to add another character slot with the introduction of the Death Knight, which means that you would have to either delete or transfer a character, if you wish to roll a Death Knight on a realm that already has 10 characters on it. source

Personally, I don’t have a problem with this but then again I only have 7 slots in my main server filled and I only really play 2-3 of these characters. I really won’t have a problem even if I do decide to play a DK seriously when the expansion comes out. Bit I’ve seen several of my friends who love making alts so much that they’re really pushing the limit of their character slots and they can’t bear to have even one of their toons deleted. I know quite a few people who play two accounts to make room for all their alts (and this gives them the advantage of playing two of their toons side by side, giving them a nice option to run the lowbie alts through dungeons). of course, not everyone has this option.

I understand that adding character slots would probably mean an upgrade in the hardware the servers use but it would really be sweet if Blizzard added even at least one extra slot for the altaholics out there. then again, maybe we all should just follow Vaneras’ suggestions.

Sega Commercial Saturday: Chu-Chu Rocket

We here at Sega Nerds have always loved Chu-Chu Rocket and fondly remember the days of our online shenanigans to this day. What makes this commercial great, aside from the disturbingly catchy song, is how cute it is to see a cat chomping on small, unsuspecting mice, and then see a rocket explode through said cat’s body.

Ahh, I miss Chu-Chu Rocket.

Sega Rally 3 video and impressions

~Remake of the Desert course from Sega Rally ‘95~ 

Just a day or two ago we reported on an event held by Sega-Amusements Europe (the arcade division of Sega Europe), show casing the brand new Sega Rally 3.  While we didn’t get to attend, the guys at Arcade Heroes did, which is where we got the info about the game from before. 

Well, now the guys at Arcade Heroes have been kind enough to share their hands-on impressions with everyone, and post up some video footage of the game.

The game sounds pretty damn good, and from the above video, I think you guys can agree it certainly looks good.

Apparently the game is looking better and running smoother than the console versions of Sega Rally Revo on the Xbox 360 and PS3.

The most immediately obvious changes are in the technology and consequently the graphical performance. Sega Rally 3 runs on the brand new and extremely powerful Europa-R board, which sports a dual core Intel processor, 4 gigabytes of RAM and an 8800 series NVidia graphics chipset. This allows the game to run at 60 frames per second at a 720p resolution, as opposed to the 30 frames per second of the console game.

The difference is actually quite staggering, and the higher framerate allows for the design of the game to really shine through - from blue skies and sandy beaches to little flourishes like a rocket launch in the Canyon stage. I really would go so far as to say that it is the best looking arcade game that I have yet seen, and that includes Sega’s own efforts on the Lindbergh board.

Also, unlike what quite a few people on the forums seem to believe, Sega Rally 3 is not a direct port/copy of Sega Rally Revo.

All of these courses are unique to Sega Rally 3, though some elements of Sega Rally Revo are noticeably present - it seems that in many cases, the most memorable turns have been cherry-picked for inclusion (in particular, Canyon’s long easy right on the hydroelectric dam, and Alpine’s multiple hairpins).

Also the cabinet is sounding quite good.  Which is always important for an arcade game, part of the fun is how it all looks and feels!

The cabinet itself is great. The set-up at the event was six linked super deluxe cabinets, with 62″ DLP screens running at 720p. The cabinets feature a dual actuator motion system, which was designed specifically for Sega Rally 3 in conjunction with Sega Japan.

These are the Xbox Live Arcade games (possibly) eligible for delisting

Most of you read or at least heard the Next-Gen interview with Marc Whitten where he revealed some Xbox Live Arcade games will be delisted. The article sparked quite a bit of discussion like Game|Life’s intelligent piece on long tail economics and GameSetWatch’s excellent devil advocate’s opinion regarding artificial scarcity.

 

Gamerscoreblog, written by actual Microsoft employees, confirms the criteria for delisting. Games that have a Metacritic score of 65% or less, been on Xbox Live Arcade for over six months and have a demo to purchase ratio of less than 6% might be pulled from the Xbox Live Arcade catalog.

 

The conversion ratio is the “wildcard” factor. Microsoft has never revealed this data, but just to get some idea of what games could be delisted I went through Metacritic to make two lists. The first is for games over six months old. The second reveals what games might be delisted in the future.
